On May 17, 2024, City Council adopted regulations that allow properties to be used for charging electric vehicles (EVs).

Use Definition

Electric Vehicle Charging use is the use of a site for the charging of an electric vehicle, including battery charging stations and rapid charging stations, each as defined by the United States Department of Energy.

Where is the use permitted?

1. Electric Vehicle Charging is permitted if the site is located in a CS or less restrictive zoning district and front-faces or side-faces specific roadway types.

  • CS and less restrictive zoning districts:
    • General Commercial Services (CS)
    • Commercial Liquor Sales (CS-1)
    • Commercial Highway (CH)
    • Industrial Park (IP)
    • Major Industry (MI)
    • Limited Industrial Services (LI)
    • Research and Development (R&D)
  • Permitted roadway types:
    • Highway Roadway
    • Hill Country Roadway
    • Suburban Roadway
    • Internal Circulation Route

2. If the site is located in a CS or less restrictive zoning district and front-faces or side-faces one of the following roadway types, the use is either permitted or conditional depending on additional requirements:

  • Roadway types:
    • Core Transit Corridor
    • Future Core Transit Corridor
    • Urban Roadway
  • Additional requirements:
    • If the site is no larger than 25,000 square feet and at least 1,000 feet from the nearest EV Charging use, then the use is permitted.
    • If the site is larger than 25,000 square feet or less than 1,000 feet from the nearest EV Charging use, then the use is conditional.
Service Station Conversion
  • For sites with an existing or previous Service Station use, an Electric Vehicle Charging use is permitted if the following requirements are met:
    • The base zoning district is commercial or industrial.
    • The use has not already been converted to a restaurant or residential use.
Additional Requirements
  • An Electric Vehicle Charging use may be located at one level below grade and above.
  • EV Charging is a conditional use if the site is located within 1,000 feet of a highway cap or stitch.
